User Agreement for Clients

1. Introduction

Welcome to CuraMind Limited. These Terms of Service ("ToS") govern your use of our website and services. By accessing or using our services, you agree to comply with these ToS. If you do not agree with any part of these terms, you must not use our services.

2. Definition

• "Company"refers to CuraMind Limited.
• "User"refers to any individual or entity using our services.
• "Service"refers to the matching services provided by the Company for clients and therapists
• "Client"refers to users seeking therapy services.
• "Therapist"refers to users providing therapy services.

3. Eligibility

Users must be at least 18 years old and have the legal capacity to enter into these ToS. By using our services, you represent and warrant that you meet these requirements.

4. User Accounts

• Users must create an account to use our services.
• You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. Excluding the measures listed in our Privacy Policy.
• You agree to provide accurate and complete information when creating your account and to update this information as necessary.

5. Service Description

Our service provides a platform to match clients with therapists. We do not provide therapy services ourselves but facilitate the connection between clients and therapists.

6. Payment Terms

• Clients’ session payments are to be made using our third-party payment processing partner, Stripe. CuraMind does not hold responsibility for processing client payments to therapists.
• Therapists will receive weekly payouts into their designated bank account from our third-party payment processing partner, Stripe. CuraMind will release the funds owed to the therapists every Thursday evening. Stripe will then operate on their own terms of service, and therapists can expect payments 2-3 business days from Thursday evening.

7. Cancellation and Refunds

• Clients may cancel appointments according to the cancellation policy set by the therapist.
• Refunds will be processed according to our refund policy, which may vary depending on the circumstances of the cancellation.

8. User Conduct

• Users agree to use our services in a lawful and respectful manner.
• Prohibited activities include but are not limited to: harassment, impersonation, engaging in illegal activities, criminal acts, harmful behavior, and bullying. If such actions occur, there will be consequences including potential termination of service and reporting to the appropriate authorities.

9. Intellectual Property

All content and materials on our platform, including text, graphics, logos, and software, are the property of the Company or its licensors and are protected by intellectual property laws.

10. Disclaimers and Limitation of Liability

• Our services are provided "as is" without warranties of any kind.
• The Company is not responsible for any damages arising from the use of our services, including but not limited to indirect, incidental, or consequential damages.

11. Indemnification

Users agree to indemnify and hold the Company harmless from any claims, damages, or expenses arising from their use of our services.

12. Modifications to the ToS

We reserve the right to modify these ToS at any time. Users will be notified of any changes, and continued use of our services constitutes acceptance of the modified terms.
